Homeless in Arizona

Sunday, February 10, 2013 - Falsely Arrested in Tempe - Again

OK, I guess I wasn't falsely arrested this time because the cop did tell me several times I was free to go, and when I left he didn't prevent me from leaving.

But the Tempe police office did violated my Constitutional rights by continuing to question me after I took the Fifth Amendment.

It was just before 11:00 a.m., I didn't get the exact time, on Sunday, February 10, 2013.

I was at Daley Park, which is just south of the railroad tracks and just east of College Avenue.

I was laying on the grass, which is 100 percent legal last time I checked, and the cop came up from behind me and started to question me.

He came up from the railroad side of the park.

To each question I told the cop I was taking the 5th and that I was not going to answer them.

But the cop continued to question me.

The cop lied and continually told me that for some reason the 5th Amendment didn't apply here, as cops always do when the flush your Constitutional rights down the toilet.

Finally I told the cop something like,

Look, in Miranda vs Arizona it says when a suspect request to remain silent the police shall immediately cease questioning him.
It gave me some lame BS saying Miranda v Arizona didn't apply here because I was not a "suspect".

During the conversation the cop said a number of times that for various reasons I didn't have any 5th Amendment rights, and I said something like if I filed a lawsuit in Federal Court for civil right violations he would end up committing perjury, denying saying that I didn't have any 5th Amendment rights.

Well I guess I will get to sue the piggy and see if he commits perjury when I question him.

I suspect he will.

These pigs are not stupid morons who don't understand the law.

They are criminals who intentional flush the law down the toilet so they can improve their arrest record.

I also told the piggy that the law doesn't matter for cops.

They have a gun and a badge and that makes them above the law.

I am getting pretty angry now and should stop typing.

As I was leaving I looked around for the piggy's car but I could not find it.
